Consumers tap savings, credit to boost spending

The daffodils are up, the job and housing markets are improving, businesses are more upbeat and consumers are getting back in a spending mood.

Unfortunately, American households are dipping into savings and tapping credit cards to pay for their latest shopping spree. Unless their paychecks begin expanding at the same pace, the new?spending, and the boost it's giving to the economy, may not be sustainable.

"While households want to spend and will raid their bank accounts to support that habit, unless income gains start improving consumption will have to slow," said Joel Naroff, chief economist at Naroff Ecoomic Advisors.

After a long, slow recovery from the 2007 recession, consumers are feeling more upbeat about the economic outlook in 2012. Five years after the worst housing collapse since the Great Depression, home prices in many markets are beginning to stabilize and sales are perking up. The job market, though still very tight in?many industries and occupations, has been creating new openings at a healthy clip. The stock market is up nearly 30 percent in the past six months.

All of which?helped boost consumer confidence to its highest level in more than a year in March, according to the latest reading by Thomson Reuters and University of Michigan. The upbeat mood has been showing up in other consumer surveys.

It's also showing up in the data on consumer spending, which rose 0.8 percent, according to the Commerce Department. Spending on durable goods like cars and trucks rose sharply. January's spending was revised up to 0.4 percent from a previously reported 0.2 percent gain.

The spending gains have also helped boost wider optimism about the economy and has prompted some forecasters to lift their estimates for the pace of growth this year.

"So long as the consumer is spending, that's the biggie everyone is watching as they drive the economy," said Wayne Kaufman, chief market analyst at John Thomas Financial.

Not all of the spending boost came from increased confidence. Higher gasoline prices have forced households to shell out more at the pump even if their paychecks are able to stretch far enough to make up the difference. The energy component of the Commerce Department's spending data surged 3.6 percent last month, largely due to higher gasoline prices, which have jumped 62 percent so far this year.

?Some forecasters think the pain at the pump will get worse before it gets better.

"The bad news is that pump prices will start approaching the $4.15-$4.20 per gallon range by Memorial Day," said Chris Christopher, a senior economist at IHS Global Insight. "The good news is that a relatively stronger job and stock market are assisting in holding up consumer spending and confidence."

After several false starts, the job market seems to be gaining strength, adding nearly 250,000 jobs a month for the last three months, helping to bring the unemployment rate down?to 8.3 percent from 9.0 percent in September.

Some small business owners are report that they plan to hire this year. About a third of those surveyed by payroll processor Sure Payroll said they plan to take on more workers in 2012, with only two percent planning layoffs. The rest expect to keep staffing levels where they are. Nearly 80 percent of those polled said the pace of business met or exceeded their expectations in the first three months of this year.

The hope is that continued improvement in the job market will translate into higher wages, which would help sustain the recent pickup in spending. Until then, consumers are leaning on their savings and credit cards to pay for the spending increase. Personal income inched up just 0.2 percent last month;?disposable income, the amount left after taxes and inflation, fell for a second straight month,

That means dipping into savings and borrowing more. The savings rate, the amount of disposable income households have socked away, dropped to 3.7 percent, the lowest rate since August.

After steadily declining during the recession, the total level of revolving credit outstanding bottomed in May 2010 and is up 8.3 percent since them, according to the latest data from the Federal Reserve.

David Archuleta Says (Not) Goodbye to Fans


THG's second favorite Mormon is saying goodbye.

Or not goodbye, based on the title David Archuleta has given his latest video blog.

But the former American Idol runner-up is headed off on a two-year mission for the Church of Jesus Christ of Latter-Day Saints at an undisclosed country and won't be around for a very long awhile to update fans on his life or career.

"It's been a very emotional last week," David says below. "It's a decision everyone knows about but it's a very personal thing and I wanted to keep it that way. So I hope you guys respect that, and you guys have so I appreciate that."

Utah women share feelings about having cosmetic surgery

SALT LAKE CITY -- Numbers and anecdotal evidence suggest that a high proportion of people, particularly women, in Utah are having cosmetic surgery done. Doctors who perform these surgeries say Utahns are educated and open to surgeries and that women just want to look like ?themselves? before they had children; therapists say issues of body image and self-worth are considerations.

But what about the opinions of the women themselves? Here, five women share their experiences and feelings about their bodies and why they chose to have or considered having cosmetic surgery. (Names have been changed because of the sensitive nature of the topic, but identifying information has not been changed. )

?I?m kind of on the petite side, and I had 9- pound babies,? said Abby, 37, a mother of five living in Springville who had a ?mommy makeover,? a combination of breast augmentation, tummy tuck and liposuction, in 2009. ?By the time I was done having kids, it was just like I felt like I was living in somebody else?s body.?

?I had my daughter at 19 and I had no image issues before then,? said Becky, 31, a mother of two who lives in St. George and had a tummy tuck about 10 years ago. ?After I had my daughter, I looked down and the first panic moment was when I was at work. I saw four stretch marks. I had marks ... (that are) keloid, so they had texture. Every time I?d get undressed to take a shower, I didn?t want to look at my body; I didn?t want my husband to look at my body. (Then) my son pushed my muscles apart. The surgeon said he?d never seen a gap as big between the two muscles as in mine.?

?I had been married to a verbally and physically abusive man who had told me I looked like a boy when I was naked. I had given birth to two children, and my breasts had lost some volume from that, but also from weight loss in general due to all the marital stress I was under,? said Claire, now 40, from Salt Lake City. ?Upon divorcing him, I elected to get breast augmentation surgery to boost my self-esteem. I never had a problem with body image before that abusive relationship. Before I had kids, I was pretty perfect in my opinion.?

?I had saddlebags: I had to buy pants a size bigger and have my (pants) waists taken in just to fit my thighs. Honestly, it was a huge issue for me; I thought about it every single time I got dressed or went shopping,? said Deborah, 32, who lives in Ogden but is from the East Coast. ?(In my home state I would think) I have to dress to hide this, it?s nothing horrible; I can deal with it. Then I moved out here, where there are a lot more young people. I?ve never seen so many people with perfect makeup and hair.?

Four of the five women interviewed referred to a culture of image or perfection in Utah. Becky, who grew up in Hawaii and is a member of The Church of Jesus Christ of Latter-day Saints, as are all of these women, observed, ?Utah has its own culture; everything here is different. There?s Utah hair, the Bumpits (plastic hair inserts). They all wear the same thing, they wear the same jeans, the same clothes. I?m (even) seeing it with my (12-year-old) daughter?s classmates.?

?I?ve been a member of the (LDS) Church my whole life,? Deborah said. ?It seems like (in Utah) at church it?s all about appearance; back (East), church was a place to go because you need that peace. Here it?s because it?s a social club, everyone in your neighborhood goes. It was a huge culture shock when I moved here. No one (at home) had Bumpits. We were trying to get our hair to sit down.?

"I often find myself thinking that maybe the reason I have not had the privilege of finding someone to spend my life with is because I am not the ideal look of the "cookie-cutter" type of LDS woman that, in my opinion, most LDS men are looking for." Emily

Emily, who is 25 and lives in Salt Lake City and hasn?t had surgery done but considered it seriously enough that she saved up money for it, said, ?I feel a great deal of pressure to look a certain way because I am not married. Both of my older siblings were married at young ages, and I often find myself thinking that maybe the reason I have not had the privilege of finding someone to spend my life with is because I am not the ideal look of the ?cookie-cutter? type of LDS woman that, in my opinion, most LDS men are looking for.?

Emily is from Washington state and observed, ?Every time I go back to the Northwest, the pressure is gone. I feel that people are looking at me and I get all this attention. (But) when I?m here in Utah, I don?t know ... it?s just there?s all this competition with beautiful people.?

Abby said she?s never lived outside of Utah, but ?it does seem like there?s sort of this crazy, underlying drive for perfection, (the feeling that one should) bake bread and sew my children?s clothes and work out every day and look perfect.?

The women observed that there is a stigma about certain kinds of surgeries, while others are either ?acceptable? or even ?popular? and something women enjoy talking about openly.

Abby said, ?I think there?s this stigma ? (someone looks good) only because she had surgery, not because she took care of herself. There?s (also) this stigma of being worldly or vain to take that step with your appearance. (But) I have had a few come out of the woodwork (who admitted having surgery). Everyone I?ve talked to has been very happy that they did it.?

?I found out in the surgery culture that having breasts done or nose done is fine, but lipo is like cheating,? Deborah said. ?It?s kind of a quiet thing how word gets around. I only told a couple of close friends at work; my husband?s family knows because they live here. I don?t tell people about the lipo, because it?s like, oh, you couldn?t just stop eating.

?The breast jobs, though, everyone?s excited and talking about: ?Oh, yeah, I?ve had my breasts done.? I?ve never heard people say, ?Oh, I?ve had a nose job.? I?ve heard someone say, ?My friend had a tummy tuck;? it?s a quiet, through-the-grapevine, I- know-someone-who?s-had-that-done. Except the breasts; everyone?s proud of those. It?s like somehow that?s OK; anything else is a little vain and selfish.?

Becky said, ?Breast augmentation is really big here in southern Utah. For a little while, it seemed like you could just go to Target and grab them (breast augmentations) ? they were that popular.?

The men in these women?s lives tended to try to discourage them from going through an invasive procedure but supported them in their decisions. All of the women, except for Claire, whose former husband was abusive, said they considered surgery to make themselves feel better, not to make a mate happy.

?My husband was totally against it,? Abby said. ?He said, ?I don?t want you to die on the table!? My husband told me if I had to do it, OK, but he didn?t really want me to, but I felt so bad about my body that I did not even want my husband to see me naked.?

?My husband was really supportive,? Deborah said. ?He always said, ?You?re beautiful the way you are.? He?s the sweetest guy ever. But he said, ?I won?t get in your way.? ?

At the same time, she still hasn?t shared news of her surgery with her family back East. ?I know what my mom would say, and I don?t want to hear it. My mom will notice when she (does) see me.?

The women who had surgery all were very happy with their results and had no regrets. Deborah said, ?Part of me is disappointed with myself because I had this work done, but I know I?m so happy now that I?ve had it done. I love it.?

"The surgery made me feel like me again. No amount of counseling was going to help me because no amount was going to make me see myself any differently than just a skinny girl with a big belly." Deborah

?I would definitely do it again, hands down, no doubt,? Becky said. ?I know how sad I was before, how it affected my relationship with my husband and my children. I wouldn?t go in the water in Hawaii with my kids even though I was in a one-piece. The surgery made me feel like me again. No amount of counseling was going to help me because no amount was going to make me see myself any differently than just a skinny girl with a big belly. It was too ingrained, too deep. For me, I knew who I was before, I was just trying to get back to the me before, not be a different me.?

For Claire, the surgery was part of moving past a bad relationship. She met her current partner a month after her surgery in 1997. ?I think the surgery did add to my happiness,? she said. ?Being in an abusive relationship was horrible, so obviously I was very low at that point, and after I got out on my own and started the road back, when I did have the surgery not very long after that, it was a huge confidence boost.?

There were a few costs, in terms of money and some drawbacks. Claire, for instance, had one of her implants deflate and had to decide whether to have another surgery to remove them entirely or put in new implants. Since no one at her workplace knew she had implants, in the week between the deflation and her new surgery, she had to stuff a sock in her bra.

At that time, in 2007, Claire did decide to have new implants inserted. But ?if they need to be replaced every 10 years, I think in five years, I?d consider getting them taken out just so I wouldn?t have to worry about getting them done again. I don?t have the body complex anymore that I used to.?

Recovery also can be a challenge. ?I tell you one thing I was not prepared for is the skin is now numb; right where the surgeon cut, about a few inches above and below the belly button, I can?t feel anything on the surface of my stomach,? Becky said. ?That?s one of the side effects I didn?t count on.?

Deborah said, ?The one thing no one told me, which I found it online, is that you?ll never gain weight in that same area again. Your body still wants to gain weight somewhere, so it?ll go somewhere else. Now I?m starting to gain a little bit of fat on my stomach for the first time ever. I didn?t know that your body would do that, but I?d still do (the procedure) again.?

Prices for the procedures vary, and none of the surgeries was covered by insurance. Abby?s mommy makeover cost $13,500. For her family, the cost wasn?t an issue because their income is high.

Becky?s tummy tuck cost $6,000, which she paid for on a credit card. The liposuction on Deborah?s outer thighs cost her $2,500. Claire paid about $3,500 for her first breast augmentation in 1997, for which she used a credit card, and about $3,200 the second time, for which she used funds from a second mortgage.

Overall, these women were pleased with their results, despite any costs or stigmas; those who had surgery after pregnancies feel better being ?restored? to pre-baby bodies.

In the Latest Issue of New Jersey Super Lawyers & Rising Stars ...

The latest issue of New Jersey Super Lawyers & Rising Stars magazine is now available online, as a digital magazine, and, of course, in print.

Cover subject Domenick Carmagnola, an employment lawyer at Carmagnola & Ritardi, found the recipe for success young in life, while working at his family's Italian restaurant.

"Real estate law keeps you on your feet, always reading people, always figuring out different personalities," she says. "It stays complicated, which means it stays interesting."

Feature subject Michael A. Gill, a family law attorney at?Goldenberg Mackler Sayegh Mintz Pfeffer Bonchi & Gill, has blue-collar roots. A former boxer and bricklayer, he has combined book smarts and street smarts into a highly successful practice. But he is not one to incite hostilities in an already highly charged area of the law.

"I don't want a father making custody an issue if he doesn't really want custody and is just trying to hurt his ex-wife," Gill says. "I tell people, 'My job is to minimize your exposure and get a fair amount.' "

We also check in with business litigator Keith Biebelberg, with Biebelberg & Martin, who fought for his clients after the developer of their condo put up another building that blocked their panoramic views of Manhattan.

She became the first female justice on the Colorado Supreme Court in 1979, and, as an appellate lawyer, was lead counsel for the plaintiffs in overturning the Amendment 2 case (Romer v. Evans) before the U.S. Supreme Court in 1996. In the latest issue of Colorado Super Lawyers & Rising Stars magazine, in a Q&A entitled "Lone Ranger," we talk with Ms. Dubofsky about her extensive career, the difficulty of being a judge, and how much longer she'll practice law.

What follows is the first of two blog-exclusive excerpts from that interview.

You're a member of a lot of bar associations and legal organizations. Is there one that's been particularly helpful or useful to you?
I've really been unhappy with myself sometimes. I've never been very involved in bar association activities. I belong. But I've never really been involved. Mostly because of time. I've been on boards of other organizations, and some of them I've been more involved in than others.

Such as?
There are a couple of public policy groups in Denver--one called the Bell Policy Center, of which I was one of the founding members. It was designed to develop policies that were more progressive for state legislators and local government in the state. They're still doing it.

Gingrich revamps campaign to deny Romney delegates

(AP) ? Republican presidential candidate Newt Gingrich is drastically reorganizing his money- and delegate-deprived campaign, scaling back a traditional operation to focus on low-cost social media and an effort to cajole delegates to back him over front-runner Mitt Romney.

One-third of Gingrich's campaign staff has been laid off and his campaign manager has been asked to resign, Gingrich spokesman R.C. Hammond said Tuesday night.

The new strategy hinges on preventing Romney from winning the 1,144 delegates he needs for the nomination, Hammond said. Gingrich plans to spend much less time in primary states and will instead personally call delegates to try to persuade them to back him at the Republican National Convention in August.

"We are not going to cede to Mitt Romney's strategy to take the party down," Hammond said. Ultimately, Gingrich would bring the fight to the convention floor, Hammond said.

Gingrich still promises to support Romney if Romney collects the necessary delegates before the party convenes in Tampa, Fla., Hammond said. In the meantime, Gingrich planned to shift the campaign's focus to digital outreach ? in particular YouTube, Twitter and other social media.

Gingrich's campaign manager, Michael Krull, was asked to resign. Hammond and campaign communications director Joe DeSantis will remain with the campaign. Both have been working for Gingrich for more than a year, even as a group of consultants quit the campaign last summer.

The rollback in the campaign comes after Gingrich listed more than $1.5 million in outstanding debt by the end of February, according to Federal Election Commission filings, including legal fees and advertising production costs. At the same time, he had about $1.5 million cash on hand, the least of the four GOP candidates.

Campaigning Tuesday in Maryland, Gingrich conceded that he is strapped for campaign funds. "The money is very tight, obviously," he said. "That's why we're trying to raise more money."

Rick Santorum, Gingrich's rival for the anti-Romney vote among conservatives, responded to the news that Gingrich was scaling back his campaign by urging Republicans to back his effort, not Romney's.

"One of the things I was told very early on in presidential politics is that you run for president as long as the money hangs on," Santorum told reporters Tuesday night in Delavan Lake, Wis.

"I think it is time for all the Republican candidates to coalesce behind me," Santorum said. "You know, let's just have a conservative nominee to take on Barack Obama. Until that time happens, I'm not going to call on anyone to get out."

Hobbled by weak fundraising and well behind Romney in the hunt for delegates, Gingrich has been under growing pressure to help unify Republicans by dropping out of the race.

In a nod to those who think he should give way to Romney, Gingrich on Tuesday pledged to support his rival's bid if the former Massachusetts governor wins enough convention delegates to clinch the nomination by the end of the GOP primary season in June.

"Obviously I will support him and will be delighted to do anything I can to help defeat Barack Obama," Gingrich told reporters in Annapolis, Md. Republicans vote in the Maryland primary next week.

If Romney falls short, Gingrich said, "I think you'll then have one of the most interesting, open conventions in American history."

Gingrich tried to position himself as an antiestablishment figure in the race while playing up the 20 years he spent in the House, including a stint as speaker. He has struggled since his campaign peaked just before the Iowa caucuses kicked off the nominating process in January. Devastating attacks from Romney and a Romney-aligned super PAC have helped to deny him further victories.

Gingrich had hoped for a Southern-based comeback in the race, but Santorum won contests in Mississippi, Alabama and Louisiana.

The former House speaker has won just two primaries, in South Carolina and Georgia, and has less than 15 percent of delegates so far.

Romney is the front-runner with 568 delegates, based on a tally by The Associated Press. That is slightly less than half the needed 1,144 delegates, and more than four times as many delegates as Gingrich, who has 135.

Pixel density of the 1280 x 800 display will be down on what the hot iPad offers ? 196 ppi versus 264 ppi ? but it is a bright, colorful, rich panel with fantastic viewing angles.

Samsung is arguably Apple?s strongest rival in tablets, and the Galaxy Tab 7.7 shows the degree of polish the corporate can achieve. It is not cheap ? $499.99 with a brand new Verizon LTE agreement ? but it?s beautifully made and extremely portable; more details in our full review.

B&N NOOK Tablet

Apple?s iPad 2?has been kept on because the entry-level model within the company?s tablet range, now $399, but Barnes & Noble?s NOOK Tablet?undercuts it considerably: $249 for the unique version, or $199 in case you can handle less storage and memory. It is a 7-incher just like the Samsung, but with the cheap focus; however, Android enthusiasts with a mind for tinkering have discovered it is also an amazing place to begin for hacks and tweaks.

Anti-iPad: Three Android Alternatives

B&N would rather you stuck with its ebook store and app download store, and usefulness from the reskinned interface is easy if unsurprisingly lacking the rate and gloss of the recent iPad. Still, at half the worth, for web surfing, messaging, ebook reading and multimedia the NOOK Tablet is an exceptional and affordable choice.

But wait?

More choice is within the pipeline, and never just running Android. Windows 8 marks Microsoft?s ward off into the tablet segment, with the primary models expected in late 2012. Microsoft has done a lot of work bringing its Metro UI in control with finger use, and the brand new support for ARM processors should mean the standard Windows tablet bugbears of short battery life, heavy build, mediocre performance and loud fans are all addressed.

Airline passengers may get a break on electronics

WASHINGTON (AP) ? The government is taking a tentative step toward making it easier for airlines to allow passengers to use personal electronic devices such as tablets, e-readers and music players during takeoffs and landings.

The Federal Aviation Administration said Monday it is "exploring ways to bring together all of the key stakeholders involved" ? including airlines, aircraft manufacturers, consumer electronics makers, and flight attendant unions ? to discuss whether there are practical ways to test devices to see if they are safe for passengers to use during critical phases of flight.

Technically, FAA rules already permit any airline to test specific makes and models to determine if they generate enough power that they could interfere with sensitive cockpit radios, navigation instruments and other critical equipment. But few airlines have done that kind of extensive testing because there are so many devices, and testing them all ? or even many ? isn't practical.

Instead, the fallback position has been to comply with FAA rules requiring passengers to turn off all electronic devices while the aircraft's altitude is below 10,000 feet.

Even if a device were tested and approved for use today, later iterations of the same machine might be different enough that they'd have to be tested again. Today's Apple iPad, for example, isn't the same as the original iPad developed three years ago.

"Can any device do this? The answer is no. All devices are not created equal. Some have more power than others," said Kevin Hiatt, chief operating officer of the industry-supported Flight Safety Foundation of Alexandria, Va.

Another concern is the "additive effects" of a planeload of 200 people using devices at once versus one passenger using a device, said Kenny Kirchoff, senior research and development engineer at the Boeing Co.

Recently manufactured planes have more shielding built into their wiring and other electronic equipment to prevent most electromagnetic interference, but planes that pre-date the early 1990s don't have nearly as much shielding, he said.

While acknowledging "this is an area of consumer interest," the FAA said in a statement that "no changes will be made until we are certain they will not impact safety and security."

Steve Lott, a spokesman for Airlines for America, a trade association for major carriers, said airlines would "work cooperatively with the FAA on any opportunities to evaluate personal electronic devices to ensure customers can use these products safely during flight."

One device that won't be included in the discussions: Cell phones, including smartphones. Another government agency ? the Federal Communications Commission ? already prohibits their use aloft for reasons unrelated to safety concerns. Because planes travel at hundreds of miles per hour, cellphones on airliners could skip so rapidly from cell tower to cell tower that they might interfere with the service of phone users on the ground, aviation experts said.

Consumer demand to use personal electronics at all times on board planes has been increasing, especially on flights with long delays waiting for takeoff.

A study released in January by Chaddick Institute for Metropolitan Development at DePaul University in Chicago found that tablet use on commercial flights is growing rapidly. An estimated one in twelve airline passengers are using a tablet, the study said.

"We estimate that 'technology-available time' is reduced by about 30 percent on short flights ? or more on really short flights ? due to prohibitions on use the devices at takeoff and landing," Joseph Schwieterman, director of the institute, said.

At the same time, American Airlines has received FAA permission for some of their pilots to use iPads in cockpits. Such "electronic flight bags" are an alternative to hauling around pounds of paper operating manuals and navigation charts.

"The average passenger starts to think, 'Wait a minute. If they're using them in the cockpit, why can't I use them in the cabin?' " Hiatt, a former airline pilot, said.

There have also been several high-profile scraps between passengers and cabin crews over use of the devices. Actor Alec Baldwin was booted off an American Airlines flight in Los Angeles in December for refusing to quit playing a word game on his cell phone after a flight attendant ordered him to shut down the device.
